Arkansas DWI FAQs

Can Arkansas DWI/DUI penalties be avoided or reduced?

Absolutely! Most DWI consequences can either be reduced or eliminated if DWI charges are dismissed or reduced to a lesser offense. 

For example, if you act quickly and call our office, a skilled DWI/DUI lawyer can request a DMV hearing to save your license, and use trial-proven defense strategies to secure a positive outcome to your case.

If convicted of a first offense alcohol offense, will your fines be $1,000 to $5,000 plus court cost?

Typically, the fine range for a DWI 1st Offense in Arkansas is between $150 and $1,000. A $5,000 fine is more common for repeat offenses, like a DWI 2 or a DWI 3.

 

 

Is a DWI a felony?

There are two ways to escalate a DWI to a felony. 

The first is having several repeat offenses. If you are convicted of a fourth DWI offense within a 10-year period, the charge will be bumped up to a Class D Felony. 

The second way is when there are aggravating circumstances surrounding the DWI event. These include:

  1. Killing or injuring someone while driving under the influence
  2. Having a minor (under 16) in the vehicle upon arrest. 
  3. Being charges while driving on a suspended or revoked license due to a prior DWI

How long will your license be suspended/revoked for a DWI?

This depends on the number of convictions someone has on their record. If it is a first-time offense, you will receive a six-month suspension. If you have a fourth DWI within five years of the first one, this will lead to a four-year suspension. 

What is the difference between a DUI and a DWI?

The distinction between DWI and DUI in Arkansas is made based on the age and BAC level of the driver.

DWI (Driving While Intoxicated): For drivers 21 and older with a BAC of 0.08%+, or when impairment is obvious.

DUI (Driving Under the Influence): For drivers under 21 with a BAC of 0.02%+, even if they don’t appear drunk.
